End User License Agreement

This End User License Agreement ("Agreement") governs the TeXBB Windows application and its TeXBB Android companion (together, the "Software"). By installing, accessing, or using the Software, you agree to this Agreement. If you do not agree, do not install or use the Software.

1. Ownership

The Software is licensed, not sold. Kiyuob Jung retains all right, title, and interest in the original TeXBB code, user interface, documentation, name, logos, and other TeXBB assets. Third-party components remain the property of their respective owners and are governed by their own license terms.

2. License grant

Subject to this Agreement, you receive a limited, personal, revocable, non-exclusive, non-transferable license to install and use the Software for lawful personal or professional work on a reasonable number of devices that you own or control. The Windows application and Android companion may be used together under this single-user license.

3. Restrictions

Except where applicable law expressly permits an activity despite this restriction, you may not:

• copy, publish, redistribute, sublicense, rent, lease, sell, resell, or commercially host the Software or any access to it;
• transfer this license or make the Software available as a shared service;
• reverse engineer, decompile, disassemble, decrypt, bypass, or attempt to discover the source code or protected operation of the Software;
• remove or alter copyright, trademark, license, security, or attribution notices;
• circumvent technical protections or use the Software to violate law or the rights of another person; or
• use the TeXBB name, logo, or other brand assets in a way that suggests sponsorship, endorsement, or ownership.

These restrictions do not override rights that cannot lawfully be excluded, including any right to reverse engineer solely for interoperability when and to the extent such a right is mandatory under applicable law.

4. Your files and responsibility for backups

You retain your rights in manuscripts, drawings, references, images, and other content that you create or import. You are responsible for the legality of that content and for maintaining appropriate backups. Sync, export, preview, history, recovery, and backup features are conveniences and are not guaranteed backup services.

5. Privacy and local connectivity

TeXBB may store settings, working files, logs, diagnostics, and generated output on your devices. Features that connect the Windows application and Android companion may transfer selected content over a network you use. Data handling is further described in the current TeXBB Privacy Policy. You are responsible for securing your devices, accounts, networks, and access codes.

6. Updates and compatibility

Updates may add, remove, repair, or change features and may be delivered by an application marketplace or another TeXBB distribution channel. An update may be required for security, compatibility, or continued companion connectivity. No particular feature, file format, operating-system version, third-party tool, or online service is promised to remain available indefinitely.

7. Third-party components and external tools

The Software may interoperate with or display material produced by third-party software and services. Third-party components, when included or accessed, are licensed under their respective terms rather than this Agreement. Nothing in this Agreement limits rights granted by an applicable third-party license. See the Third-Party Notices for more information.

8. Support

Support and issue-reporting channels may be offered on a reasonable-efforts basis. Unless a separate written support agreement says otherwise, response times, fixes, continued availability, and restoration of data are not guaranteed. Do not send confidential manuscripts or credentials in a support request unless specifically requested through an appropriate secure channel.

9. Termination

This Agreement terminates automatically if you materially breach it. Upon termination, you must stop using and uninstall the Software, except that you may retain your own documents and any copies that applicable law requires you to keep. Sections concerning ownership, restrictions, third-party terms, disclaimers, liability, and mandatory law survive termination.

10. No warranty

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SOFTWARE AND SUPPORT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY. THIS INCLUDES, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND DATA PRESERVATION. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS, SO SOME OF THESE EXCLUSIONS MAY NOT APPLY TO YOU.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KIYUOB JUNG WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST DATA, LOST WORK, LOST PROFITS, BUSINESS INTERRUPTION, OR THE COST OF SUBSTITUTE SOFTWARE, ARISING FROM OR RELATED TO THE SOFTWARE, EVEN IF ADVISED THAT SUCH DAMAGE WAS POSSIBLE. WHERE LIABILITY CANNOT BE EXCLUDED, TOTAL LIABILITY ARISING FROM OR RELATED TO THE SOFTWARE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID FOR THE SOFTWARE DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR USD 5.00. THIS LIMITATION DOES NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED.

12. Marketplace and platform terms

Microsoft Store, Google Play, operating-system, payment-provider, and device terms may also apply. If a mandatory marketplace term conflicts with this Agreement concerning acquisition, installation, automatic updates, refunds, or use of that marketplace, the marketplace term controls only to the extent of that conflict. The marketplace and platform providers are not responsible for TeXBB support except as their own terms expressly require.

13. Mandatory law; no invented choice of jurisdiction

This Agreement is governed by the law that applies under mandatory conflict-of-law rules. It does not select a court or jurisdiction that would deprive you of non-waivable consumer protections, statutory rights, or remedies available in your place of residence. Any dispute must be brought in a forum having lawful jurisdiction under those rules.

14. General terms

If a provision is unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will continue in effect. Failure to enforce a provision is not a waiver. This Agreement, the applicable Privacy Policy, included third-party notices, and any mandatory marketplace terms are the entire agreement concerning your license to the Software unless you and Kiyuob Jung sign a separate written agreement.
